Notice of Extension of Time Application
Pursuant to sections 239AT(3) of the Companies Act 1993
On 22 September 2026, Iain Shephard and Jessica Kellow, Licensed Insolvency Practitioners of BDO Wellington, were appointed administrators (Administrators) to the Company.
Watershed Meeting
At the first meeting of creditors, it was advised that the Administrators were considering making an application to the High Court to extend the “convening period” (as defined in the Companies Act 1993) in which to hold the watershed meeting of creditors.
Notice is given that the Wellington High Court has provided the Administrators with the orders sought and the timeframe by which the Administrators must convene the watershed meeting for the Company has now been extended by four months to 17 March 2027.
Once a date to hold the watershed meeting has been determined by the Administrators, all creditors will be provided with notice of the meeting, a report on the affairs of the Company with the Administrators’ recommendations, and the necessary voting forms.
The Court requires that the orders made be advertised within seven days of the date of the orders, in the New Zealand Herald and the Dominion Post newspapers, and posted on the BDO and Speirs Foods websites.
Continued Trading of the Company
During this period, the Administrators are continuing to trade the business of the Company in the usual manner. The Administrators wish to thank the staff, suppliers and other stakeholders for their support during this time.
